PENDUDUK KAMPUNG BEREMBANG DI KEMENTERIAN PERUMAHAN!

Pagi ini, penduduk Kampung Berembang diberi sedikit harapan oleh Dato Sallehudin B.Yeop Mat Deli selaku Ketua Pengarah Jabatan Perumahan Negara yang menerima memorandum penduduk Kampung Berembang bagi pihak i Dato Seri Ong Ka Ting di Kementerian Perumahan dan Kerajaan Tempatan apabila beliau berjanji akan menyelesaikan masalah perumahan 68 keluarga yang telah diabaikan oleh kerajaan negeri.


Seramai 200 orang yang terdiri daripada penduduk kg.Berembang, penduduk kampung-kampung peneroka di Selangor dan Kuala Lumpur, aktivis dari Parti Sosialis Malaysia (PSM), Jaringan Rakyat Tertindas (JERIT), kumpulan pelajar, DEMA dan kawan-kawan NGO dan individu yang prihatin telah berkumpul di hadapan Kementerian Perumahan di Pusat Bandar Damansara dari pukul 10.30pagi untuk menuntut Dato Seri Ong Ka Ting menyelesaikan dengan segera masalah perumahan penduduk Kg. Berembang yang kini berlanjutan untuk 9 bulan.


Kini, Sudah lima kali rumah penduduk kg. Berembang dirobohkan iaitu dari 17 Nov 2006 hinggalah 7 Mac 2007, namun penduduk tetap membina rumah dan menduduki kawasan bersebelahan Kg.Berembang. Mereka tidak gentar kepada kuasa kerajaan negeri yang kini membalas dendam mereka kerana melawan dan mendakwa kerajaan negeri di mahkamah atas penggunaan ordinen 69 ( pembersihan setinggan).

Pemaju yang beria-ia merobohkan rumah pada satu ketika, kini cuba jadi budak baik di mana dalam satu perjumpaan yang dipengerusikan oleh SUHAKAM dan dihadiri oleh wakil pemaju dan wakil penduduk pada 27/6/07, wakil pemaju mengaku mereka sedia bagi rumah di projek perumahan Berembang Indah tetapi mereka tidak dapat berbuat demikian kerana menunggu arahan dari kerajaan negeri. Manakala dalam satu kenyataan akhbar (KOSMO- 19/4/07) kerajaan negeri telah menyatakan seolah-olah pemajulah yang bertanggungjawab untuk menawarkan rumah.Apa yang pasti , kerajaan negeri sedang membalas dendam, pemaju pula berlindung di belakang kerajaan negeri.


Dalam perjumapaan dengan Dato Sallehudin pagi ini, pada awalnya beliau telah menyatakan pendirian kementerian untuk tidak campurtangan dalam isu Kg.Berembang kerana ia melibatkan tanah dan isu tanah adalah dalam bidang kuasa kerjajaan negeri dan bukannya dalam bidang kuasa kementerian. Kemudian Dato Sallehudin telah menawarkan Perumahan di Projek Perumahan Rakyat- sewaan (PPR) di sekitar Selangor yang menurutnya penawaran PPR adalah dalam bidang kuasa kementerian.


Namun pendirian ini telah dibantah oleh wakil-wakil kampung yang diketuai oleh Sdr. Noralizan yang merupakan Pengerusi Jawatankuasa Penduduk Kg. Berembang yang kemudiannya telah menerangkan sikap kerajaan negeri yang sedang membalas dendam dan pemaju yang sedia tawarkan rumah tetapi dihalang oleh kerajaan negeri. Berkenaan dengan perumahan PPR, penduduk bukannya tidak mahu terima tawaran itu tetapi PPR adalah sementara dan sewaan manak ala penduduk mahukan satu rumah sendiri yang tetap.Memandangkan lokasi Projek Perumahan Berembang Indah adalah dekat maka mereka sanggup membelinya jika ia ditawarkan kepada mereka. Maka wakil-wakil kampung telah menuntut YB Menteri menggunakan kewibawaan politik untuk berbincang dengan kerajaan negeri dan pemaju. Maka Dato Sallehudin pun setuju untuk membawa isu ini kepada pihak Menteri dan seterusnya mengadakan perbincangan dengan kerajaan negeri untuk menyelesaikan masalah ini.


Keputusan Dato Sallehudin ini amat dialu-alukan tetapi pada masa yang sama jika kementerian gagal mengambil tindakan dengan segera maka penduduk berjanji akan kembali ke kementerian dengan lebih ramai orang untuk menuntut hak mereka!

Malaysia Govenrment trys to oppress bloggers

Malaysia Govenrment is trying to oppress bloggers. I am worry that Malaysia Government is trying to control the freedom of expression on internet. My government already controlled everything and all mass media except internet. But now, they want to control also internet. What kind of government is this? A little of space also does not give to the people.

Umno has filed a police report against political website Malaysia Today for allegedly publishing disparaging remarks against the King and Islam. The report was filed at the Dang Wangi police station by Umno information chief Muhammad Muhammad Taib this afternoon. He was accompanied by some 30 people.

Malaysia Today had published numerous articles containing allegations of corruption and abuse of power against the chief minister and police chief, which had since been denied. The website had also been highly critical of the prime minister and his son-in-law Khairy Jamaluddin, who is also Umno Youth deputy chief. The police report today came hot in the heels of the July 13 arrest of blogger and PKR webmaster Nathaniel Tan (left) under the Official Secrets Act. Tan, who was detained for four days, was released on police bail last Tuesday.

"The time for talk is over, now is the time to act." With this warning shot, Minister in the Prime Minister’s Department Datuk Seri Nazri Aziz said the government would be taking legal action against bloggers.

He told the Dewan Negara yesterday that three laws could be used against the bloggers: The Internal Security Act (ISA), Sedition Act and Section 121b of the Penal Code.Section 121b deals with offences against the authority of the king, ruler or Yang DiPertua Negeri and carries a maximum penalty of life in prison.Speaking at the Malaysian Press Institute Press Awards Night here yesterday, Deputy Prime Minister Datuk Seri Najib Razak said the government was deeply troubled by the growth of "irresponsible" alternative media."In the name of freedom, these websites allow the broadcast of slander, lies and swearing, the use of harsh, degrading language and racial slurs without regard for the reader or those concerned," he said.

But who is the racist? Actually, the most frequent to voice out racial things is our own government.

Timbalan Perdana Menteri berkata, kebebasan menulis atau memberi pandangan ada hadnya dan kerajaan tidak akan membiarkan mana-mana pihak mengganggu gugat perpaduan negara serta menimbulkan keresahan di kalangan masyarakat.

But who is the real person that destroys the unity of people? Actually, a racism government (Malaysia current government) is destroying the unity and harmony of people.



Luckily, there are still having some people brave to voice the truth and justice:
The government should stop going after bloggers, Gerakan central committee member Datuk Toh Kin Woon said yesterday.


Toh said the recent arrest of Nathaniel Tan, a blogger affiliated with the opposition Parti Keadilan Rakyat, and the call by Umno to take police action against the Malaysia Today website reflected a growing trend towards stifling dissent in the country.

He said that as the nation moved forward, the government could not be content with promoting development to the detriment of human rights."Civil and political rights such as the right to free speech, dissent and assembly are as important as economic rights such as the right to a job, housing, medical care and education."

What you can do if you love freedom and justice?
1. Send a letter or statement to urge Malaysia Government to stop taking any action on bloggers.

2. For Malaysia citizen, please vote the opposition parties if Malaysia Government has taken any action to against freedom of expression (human rights) and bloggers.


History will write down the truth. Finally, the person who has done violation will be cast aside by the people!

Pulihkan pilihanraya dan demokrasi, himpunan rakyat 10 November 2007!

Semalam (20 July 2007, Jumaat), saya telah menghadiri Konvesyen BERSIH yang bertemakan 'Bersihkan Pilihan Raya, Kembalikan Hak Rakyat'. Begitu ramainya hadiran-hadirin! Harapan tetap di depan kita! Hidup perjuangan rakyat! Teruskan perjuangan dan usaha kita!

Beberapa keping gambar telah diambil dengan handset yang uzur saya.


Gabungan Pilihanraya Bersih dan Adil (Bersih) mengisytiharkan 10 November depan sebagai tarikh himpunan besar-besaran rakyat yang akan diadakan di Kuala Lumpur bagi menuntut pilihan raya yang bebas serta adil termasuk memulihkan demokrasi negara yang semakin pincang.

Konvesyen BERSIH pada semalam (20 July 2007) yang bertemakan 'Bersihkan Pilihan Raya, Kembalikan Hak Rakyat' turut dihadiri oleh para pimpinan tertinggi parti politik seperti Presiden PAS Dato' Seri Tuan Guru Abdul Hadi Awang , Penasihat KeADILan Dato' Seri Anwar Ibrahim, Setiausaha Agung DAP Lim Guan Eng, Penaja Parti Sosialis Malaysia Dr Nasir Hashim, beberapa pimpinan serta Ajk PAS Pusat dan 25 wakil-wakil badan-badan bukan kerajaan (NGO) seperti CIJ, Jerit, Wami, Aliran, Gamis, Dema termasuk persatuan mahasiswa.

Ustaz Hadi yang turut berucap dalam konvensyen itu merasa terharu dengan kesungguhan serta sokongan yang ditunjukkan oleh hadirin yang terdiri daripada pelbagai kaum dan latar belakang agama malah sanggup bersatu padu dalam menentang kezaliman pemimpin BN dan memastikan agar demokrasi berjalan dengan lebih adil dan saksama kepada rakyat jelata.

"Walaupun berlainanan ideologi dan fahaman agama,kita wajib bersatu menentang kezaliman," ucap beliau disambut dengan tepukan gemuruh khalayak yang hadir.

"Perubahan tidak akan berlaku jika kita tidak berani membuat pengorbanan," katanya.

First they came... is a poem attributed to Pastor Martin Niemöller (1892-1984) about the inactivity of German intellectuals following the Nazi rise to power and the purging of their chosen targets, group after group.
I had read the poem above when I was in university.

When Nat was arrested under the bad law, Official Secrets Act (OSA), I chose to attend the Solidarity Candle-light Vigil for Nathaniel Tan . The Solidarity Candle-light Vigil was held opposite the Dang Wangi Police Station for 2 days.

Finally, we success to urge police to release Nathaniel. He had been detained for four days and then released on bail.

FREEDOM OF FAITH

I have attended the peaceful candlelight vigil on 19 June 2007, 8pm in support of Revathi, and many others like her, who are unable to fully exercise their Constitutionally-guaranteed freedom of faith.

The vigil is an initiative of civil society organisations including MCCBCHST (the Malaysian Consultative Council on Buddhism, Christianity, Hinduism, Sikhism and Taoism) and various women’s rights groups (All Women’s Action Society (AWAM), Sisters in Islam (SIS), Women’s Aid Organisation (WAO), Women’s Centre for Change, Penang (WCC) and Women’s Development Collective (WDC)).

Summary of Revathi’s case:
Revathi, an ethnic Indian woman, has been held in a rehabilitation center run by Islamic authorities since January 2007 because she wants the State to acknowledge she is a Hindu and not a Muslim.

Revathi was born to Indian parents who had converted to Islam before her birth. She claims she was raised by her grandmother as a Hindu. She and Suresh were married according to Hindu rites in March 2004. Revathi was advised by the Malacca Islamic Religious Department to make an application at the Malacca Syariah High Court to confirm her status as a Hindu. She did as she was told.

However, the Syariah Court ordered her detained in a rehabilitation centre in Ulu Yam, Selangor under Melaka's Syariah criminal laws for 100 days. This detention was extended in Revathi's absence for a further 80 days supposedly because she had not “repented”. In the meanwhile, Revathi's Muslim mother obtained a Syariah Court order granting her custody of Revathi and Suresh's 15 month old baby. That order was enforced on Suresh’s Hindu family with the assistance of the police.

The family is now torn apart - with the mother in detention, the child with the grandparents and the father in limbo without his family.

Najib should resign

Najib should resign

If Najib is a responsible leader, he must step down as the Defence Minister immediately. Najib should responsible to the use of Sikorsy S61A-4 Nuri from active service with the discovery of the crash site not far from the Genting Sempah tunnel on July 17.

It was Malaysia's 17th crash involving an S61 Sikorsky helicopter since the U.S.-made model came into service in the Malaysia 40 years agoss. Those accidents have claimed 72 lives.

The United States, the largest user of Sikorsky H-3 helicopters which the Nuri variant is based, retired its last two helicopters from active service in January 2006. While Malaysia government still using it.

Kekerapan pesawat TUDM termasuk Helikopter Nuri terhempas hampir setiap tahun sehingga mengakibatkan juruterbangnya terkorban dilihat sebagai suatu kegagalan Kementerian Pertahanan khususnya Menteri Pertahanan, Dato' Seri Najib Tun Razak dalam menangani masalah tersebut.



Nuri (Sikorsky S61) mula digunakan sejak 1968, ketika negara membeli sebanyak 31 buah pesawat dari AS. Bermula 25 April 1969 sehinggalah 29 Mei 2004, sebanyak 17 insiden nahas telah berlaku. Ia menjadi 18 jika dicampur kejadian terbaru.

Jumlah korban yang melibatkan anggota tentera, pasukan polis hutan dan orang awam adalah 82 orang.

Kalau TUDM boleh diberi helicopter canggih dan moden seperti Sikorsky S-70 dan AS -61N untuk pengangkutan Perdana Menteri dan VIP kenapa tidak helicopter canggih untuk keperluan pengangkutan dan lojistik Angkatan Tentera Malaysia?



Kronologi Nuri terhempas
Berikut adalah antara kronologi nahas membabitkan helikopter Nuri sejak 38 tahun lalu:

1. 15 Ogos 2004 – Sebuah helikopter Nuri dipercayai membawa 10 orang penumpang termasuk juruterbang dilaporkan hilang di kawasan Long Seridan tidak jauh dari Miri ke Ba’Kelalan, Sarawak.

2. 30 Mac 2004 – Tiga termasuk juruterbang terselamat apabila helikopter Nuri mendarat cemas di Bukit Kalam, kira-kira tujuh kilometer dari pusat Bandar Labuan, selepas mengalami masalah teknikal pada enjin sebaik berlepas dari Pangkalan TUDM Labuan.
3. 5 Mac 2004 – Dua anggota TUDN maut selepas helikopter Nuri terhempas di Taman Udara, Butterworth.

4. 19 Mac 1997 – Seramai 11 anggota TUDM terbunuh apabila dua helikopter Nuri jenis Sikorsky S-61 terhempas berhampiran Gunung Lumaku, Sipitang Sabah.

5. 16 Oktober 1996 – Dua orang terbunuh, tiga hilang manakala dua lagi selamat selepas helikopter Nuri terhempas di perairan Muka Head, Pulau Pinang.

6. 11 Julai 1991 – Tujuh orang maut apabila helikopter Nuri terhempas ketika cuba mendarat di Banding, Perak.

7. 10 Jun 1991 – Enam anggota tentera terbunuh apabila helikopter Nuri terhempas dan meletup di kawasan operasi tentera di Banding, Perak kira-kira jam 5.20 petang.

8. 16 Januari 1991 – Helikopter Nuri dalam perjalanan dari Stesen TUDM Sungai Besi ke Kulang Johor terhempas ketika membuat pendaratan kecemaran di sebuah estet di Kampung Parit Zin dekat Muar, Johor.

9. 28 Ogos 1990 – Helikopter Nuri yang membawa sembilan orang dalam latihan pertunjukan udara semperna perayaan Hari Merdeka terpaksa membuat pendaratan cemas di padang sebuah sekolah berhampiran Rawang, Selangor.

10. 18 Disember 1989 – sebuah helikopter Nuri terhempas berhampiran Sungai Lundu, Sarawak, mengorbankan 16 anggota Tentara Darat dan TUDM termasuk Pegawai Pemerintah Markas Divisyen Kedua, Mej Jen Dato' Mustaffa Awang dan Pemerintah Briged Ketiga Infantri, Brig Jen Dato' Hasbullah Yussoff.

11. November 1989 – Nahas terbesar membabitkan Nuri, apabila 21 orang termasuk 15 anggota Pasukan Polis Hutan terbunuh selepas pesawat Nuri terhempas di antara Gunung Gerah dan Gunung Bilah di sempadan Kelantan-Perak

12. 11 Julai 1981 – Sebuah helikopter Nuri terhempas di Batu Melintang, Perak tetapi semua 11 penumpang dan krew terselamat.

13. 25 April 1981 – Dua anggota TUDM terbunuh dan 13 lagi cedera dalam nahas helikopter Nuri ketika ribut di 30 batu nautika dari Lapangan Terbang Kuching, Sarawak. - mks.

Urgent: Nat being held at Bukit Aman!


Nat was taken away from his office today by 3 police officers to Bukit Aman. They said they “nak cakap tentang internet”.


Nat’s currently in IPD Dang Wangi lock up and is scheduled to meet DSP Victor from the cyber crimes unit. He is also scheduled to see a magistrate to decided Nat will be remanded for a longer period of time or not.

Nathaniel Tan, 26, was picked up from the office of a non-governmental organisation Yayasan Aman in Petaling Jaya. Tan is a Harvard University graduate, has been involved in the maintenance of the opposition party’s website and is also a prominent blogger.

A police report has been filed on Tan's "kidnapping" this evening.

Ex-ISA detainee backs Anwar over policy

Ex-deputy premier Anwar Ibrahim has received support from an ‘unusual source’ in the wake of criticisms over a contentious education policy he mooted while in government which subsequently led to the infamous Operasi Lalang in 1987.


Speaking at a ceramah in Selangor’s Ijok last night, veteran opposition leader Lim Kit Siang openly backed Anwar, arguing that the former education minister should be credited for showing regret for what he had done.


Lim was one of the 119 politicians, social activists, unionists, Chinese educationists and religious missionaries rounded up under the massive crackdown. He was detained for one-and-a-half year without trial under the Internal Security Act.


“I believe I am one of them because it resulted me to ‘eat curry rice’ (detained) for the second time. Do you think (BN Chinese-based parties) MCA or Gerakan are qualified? They are all accomplices in that!” said Lim in his trademark fiery oratorical style.


“Anwar has regretted for what he had done then. Shouldn’t he be given credit for it?” he asked the 400-odd crowd in Mandarin, who responded him with a loud ‘yes’.


“Has Umno, MCA or Gerakan regretted for what they did then? Who was the main culprit then? It was the Umno Youth chief then Najib Abdul Razak - the man who is leading the by-election campaign in Ijok now,” the DAP supremo added.


“He (Najib) had made the most extreme statement where he wanted to bathe the keris (Malay dagger) with Chinese blood. Why nobody asks him to apologise? Where is MCA and Gerakan? Do you think they dare to ask Najib to apologise?” thundered Lim.


The crowd responded with shouts of ‘they dare not!’ Continuing, Lim told the crowd that Anwar was courageous enough to show regret, unlike Najib and the two BN Chinese-based parties.

BERTANDING PILIHANRAYA MESTI ADA PRINSIP

Kematian ADUN MIC, K.Sivalingam adalah sesuatu yang tidak dapat diduga tetapi apa yang boleh diduga ialah setiap kali berlaku pilihanraya, maka wujud perebutan sengkit antara calon untuk mendapat kerusi. Pelbagai helah dan dalil dipertengahkan, dan antara pertimbangan pokok ialah politik perkauman dijadikan ukuran paling utama parti mana dan calon mana yang akan bertanding. Sedihnya persoalan-persoalan seperti prinsip perjuangan, track rekod calon dan manifesto menjadi perkara kedua.


Parti Sosialis Malaysia (PSM) tidak dapat bertanding atas simbol parti kerana Pemerintah melalui Menteri Dalam Negeri tidak merestuinya. Dalam dua pilihanraya yang lalu, PSM pernah bertanding menggunakan logo parti pembangkang iaitu DAP dan PKR. Yang sedihnya dalam pilihanraya yang lalu, PSM terpaksa bertanding tiga penjuru kerana tidak ada persetujuan antara Parti Pembangkang.


Untuk PSM kreteria untuk menjadi seorang calon adalah satu proses yang mesti telus, berprinsip dan satu formula yang boleh sentiasa dipakai supaya tidak wujud "double-standard" dan diskriminasi. Parti-parti perlu mempunyai satu garis yang jelas kreteria seorang calon dan bagaimana keputusan diambil.


Bagi PSM, antara kreteria untuk menjadi calon adalah seorang itu boleh dicadangkan untuk menjadi calon apabila beliau telah melakukan kerja akar-umbi disatu kawasan untuk jangkamasa tidak kurang daripada lima tahun. Calon tersebut juga mesti dicadangkan oleh para ahli di kawasan tersebut dan direstui oleh kawasan-kawasan dimana Parti PSM mendapat sokongan iaitu biasanya di kalangkan masyarakat pekerja, peneroka dan pekerja ladang di kawasan yang bakal ditanding. Itu disebabkan walaupun PSM adalah sebuah parti kecil berbanding dengan parti-parti lain, tetapi mekanisma dan jentera pilihanraya sentiasa kuat dan terdapat ramai pembantu sukarelawan.


Sesuatu aspek yang langsung tidak dilihat oleh parti PSM apabila mempertengahkan calon ialah apakah kaum, kumpulan etnik calon, adakah calon seorang yang kaya dan samada calon tersebut ada pendidikan tinggi. Yang lebih dipentingkan adalah kerja yang dibuat dan penerimaan orang tempatan atas kerja yang dibuat.


Dalam dua pilihanraya yang lalu, calon-calon PSM telah melakukan dua perkara iaitu mereka telah mendedahkan harta/asset mereka kepada umum melalui satu sidang akhbar dan mereka juga menandatangani satu pledge (akur-janji) janji-janji pilihanraya, yang diberikan di kawasan-kawasan supaya masyarakat disana dapat memantau calon selepas calon tersebut menang supaya jika calon tersebut tidak menunaikan janji, maka masyarakat ada kertas hitam putih untuk mencabar calon.


Baru-baru ini, PSM telah menyarankan kepada parti-parti pembangkang melalui Gabungan BERSIH untuk membuat deklarasi dan pledge terbuka bahawa mereka tidak akan memainkan politik kaum dan agama untuk menang pilihanraya dan semua calon pembangkang akan mengistiharkan harta. Selepas itu, kita boleh mencabar calon pemerintah untuk berbuat demikian.


Kita harus sedar bahawa adalah tidak mustahil untuk pembangkang menang dikerusi majoriti orang melayu atau cina. Ini pernah berulang ulang kali dimenangi oleh calon PAS dan DAP tetapi jika pembangkang ingin memerintah negara, maka ini hanya boleh dilakukan jika mereka boleh menang kerusi campuran. Inilah cabaran paling penting kita dan untuk menang kerusi campuran, adalah amat sukar untuk kita bermain politik kaum dan agama.


Justeru dengan itu, adalah amat penting untuk kita melihat isu pilihanraya dengan lebih luas dan bukan sebagai satu kerja jankapendek (kerja satu bulan untuk 5 tahun). Pembangkang harus lebih mempertengahkan isu-isu seperti isu agihan kekayaan, isu kesejahteraan/ penderitaan rakyat dan keadilan dan kebebasan rakyat daripada lebih memfokus kepada isu-isu yang akan menjadikan kita jaguh kaum dan jaguh agama masing-masing.


Kerja-kerja politik bukan kerja sampingan tetapi kerja membawa perubahan kuasa kepada sistem pemerintahan negara. Ia memerlukan prinsip dan daya juang yang tinggi.


Dan untuk mempertengahkan isu-isu berprinsip ini, kita perlu mempertengahkan calon-calon berprinsip, berwibawa dan sanggup berkorban dan bekerja setiap hari itu seperti setiap hari esok adalah hari pilihanraya.

Interview with a revolutionary student activist Maria Louka

"What we are seeing is an ongoing process in which the movement becomes stronger and takes on a mass character: if we take the demonstrations as a barometer, we can see today several demonstrations of 30,000 to 40,000 participants, and almost all the university departments are occupied."


Maria Louka was interviewed by Andreas Sartzekis in Athens, 11th March 2007.


Can you explain the reason for this new mobilization?


The victory that was won last summer was in fact a tactical victory, forcing the right-wing government of Karamanlis to freeze its plan of “reform” of the universities. But in January, it returned to the attack, with the intention of modifying Article 16 of the Constitution, which guarantees the public and free character of higher education. Beyond that, the objective was, if not an attempt at privatizing the sector, at least the imposition of market logic on the university world.


So there very quickly developed a big mobilization, with occupation of universities, and its character was so massive that we won a first victory: the PASOK (the Greek Socialist Party) withdrew from the process of revision of Article 16. But just after that the government demonstrated its intransigence by proposing in parliament the draft law that had been frozen since last summer! The contents of this project concern the universities and the technological institutes: o putting in question, in a restrictive sense, the sanctuary of the university; o limiting the number of years of studies to “the number of years of the student’s course multiplied by two”; o abolition of rights, such as the right to free manuals; o introduction of rules of functioning of the universities along the lines of a workplace, with the appointment of managers.


The student movement reacted to this new attempt by Karamanlis and fought back with even more strength.


What form has this mobilization taken?


It follows on from the struggle last June: in fact the struggle has been going on for nearly a year! Whether it is against Article 16 or against the draft law, it is the same battle against the dislocation of higher education. What we are seeing is an ongoing process in which the movement becomes stronger and takes on a mass character: if we take the demonstrations as a barometer, we can see today several demonstrations of 30,000 to 40,000 participants, and almost all the university departments are occupied.


Why do you think there is such violence on the part of the police?


There has in fact been a “qualitative” leap in the level of repression: massive arrests, students being beaten with clubs, use of tear gas against demonstrations: the government is trying in this way to terrorize the students. Since it sees a growing wave of exasperation, it is trying to use the tactic of suffocating the movement by repression, to dissuade the students from demonstrating on the streets.


But it is also trying on this occasion to implement a pilot program of repression which would be applicable against all future struggles in any social sector. It would like in this way to create the framework of an authoritarian state, against any form of struggle, so it is trying to put the across the message that whoever contests its policies will find themselves confronted with the police violence that we see today.


What are the links between the movement and the trade unions?


This is the most difficult point for our movement. Let me begin, however, by underlining that POSDEP, the union of university teachers, has called an unlimited strike for the whole of the present period. In spite of that the movement remains relatively isolated: the union of primary school teachers (DOE) and the union of secondary school teachers (OLME) have conducted solidarity actions: work stoppages, two days on strike since the beginning of January, but that is not up to the level of the dynamic and of the needs of the movement. The federation of public sector unions (ADEDY) has contributed a certain amount of solidarity, but we have to note the pure and simple absence of the (single) confederation of trade unions GSEE: since the beginning of January, GSEE has not even called a work stoppage so that workers could take part in demonstrations, as has often been pointed out by critics of the bureaucratic leadership of GSEE (where PASOK has a majority). At this point, the demand of the student movement is that this mobilization should not remain isolated and that there should be an immediate call for a general strike which would ensure a perspective of victory. And so the most important priority is that the workers’ movement should enter into struggle with this kind of solidarity.


Can we already draw some lessons?


Yes! First of all: we can see taking shape, in very difficult conditions, a new militant generation which, far from submitting to the government’s projects, is becoming politicized and radicalized in a lasting way. This is a very positive fact, since this generation, in whatever work situation it finds itself tomorrow, will not hesitate to launch struggles!


A second lesson is what is happening within the student movement, where several currents have played a crucial role so that the mobilization could be unleashed. The radical Left, represented mainly by the EAAK tendency, has been in the front rank: by taking care to work in a coordinated way, it has succeeded in regrouping the student movement and giving the mobilization a mass character, and thanks to a united front tactic, it came to an agreement and cooperated with all the left forces who refuse the Karamanlis plan. By doing so it has succeeded in establishing a front against the policies of New Democracy (the party of the Right) in the sphere of education.


I think that we must underline the indispensable character of having a united front tactic in the movement, and also the role that the radical Left can play, on condition that it knows how to overcome its blockages inherited from the past.


What is the place of the students of OKDE-Spartakos in the movement?


We intervene within EAAK, which, in the framework of the movement, has functioned overall in a way that we can be happy with. Having said that, there have been some situations and some problems on which we have raised questions and made proposals, with the aim of improving the intervention of the tendency. The main question for us is that of internal democracy: in reality, here and there, structures of EAAK have functioned in a way that we can call bureaucratic! That is to say that we have seen some cases where structures of EAAK have themselves taken initiatives whose effect has been to substitute for the movement. When such things happen, we criticize and we differentiate ourselves from it, and we try to act so that there is direct democracy within the movement, because that is what makes possible the involvement of everyone and control by the rank and file over the development of the movement.


What proposals for international solidarity would you make?


At this moment the question of internationalism is very important to us: we know to what extent the struggle against the First Employment Contract (CPE) strengthened our struggle in June 2006. So trade unions, organizations, sectors of the left and of the mass movement in Europe should adopt solidarity messages with the student movement and with those arrested - I would remind you that there have been very many arrests. What is also necessary is to succeed in establishing coordination between radical sectors of the student movement on a European level which would lead to concrete actions: for example, we could fix dates for common mobilizations and there could be solidarity actions in front of the Greek embassies in the capitals of Europe.

API PERJUANGAN TERUS MENYEMARAK DI KG. BEREMBANG !

PERJUANGAN UNTUK PERUMAHAN TETAP BERTERUSAN!

Mungkin ramai yang terfikir perjuangan di Kg. Berembang sudah berakhir. Saki baki rumah pondok yang dibina setelah 3 kali dirobohkan sudah ranap sama sekali. Barangan milik penduduk sudah dipindahkan keluar berhampiran pintu masuk ke kampung tersebut. Penduduk juga membuat keputusan untuk tinggal di khemah di luar kampung mereka. Jadi, perjuangan di Kg. Berembang sudah berakhir ke?

Pagi semalam, pihak pemaju Perbadanan Negeri Selangor Berhad (PNSB) terpaksa menggunakan beratusan anggota polis dan FRU untuk hanya merobohkan tiga struktur pondok dan khemah yang didirikan oleh penduduk. Semua ini tidak dapat dilakukan dengan mudah. Semangat perjuangan yang tinggi dan tentangan hebat oleh penduduk Berembang bersama aktivis JERIT dan PSM serta pemimpin parti pembangkang menjadi kerja perobohan ini mengambil masa hampir sehari. Dua hari sebelum itu, cubaan PNSB bersama pasukan RELA untuk merobohkan rumah gagal. Penduduk berjaya menghalau keluar mereka.


Namun, semalam pihak polis dari dareah Ampang Jaya telah bertungkus lumus membantu pemaju untuk merobohkan rumah penduduk. Kesungguhan pihak polis amat jelas sehingga OCPD ACP Amer Awan dan Timbalannya turun padang dari pagi hingga lewat petang. Hampir ke semua pegawai kanan polis dari IPD Ampang Jaya juga sama-sama turun padang. Kesungguhan pihak polis ini amat mencurigakan sehinggakan ACP Amer Awan tidak mahu melayan peguam yang datang mewakili penduduk. Saudara Teng, Edmund Bon dan Lateefah Koyah cuba mempersoalkan operasi perobohan yang dijalankan tanpa 'court order'. Ini adalah satu operasi haram kata mereka. Tetapi, pihak polis enggan menjawab persoalan tersebut dan terus memberi perlindungan ke pemaju dan penduduk kampung dibiarkan merana. Tidak cukup dengan itu, 5 orang ditahan oleh mereka. Dan apa yang melucukan Sdr. Tian Chua salah seorang yang ditahan akan didakwa atas tuduhan 'cubaan membunuh' kerana beliau melanggar sekatan pemaju yang menghalang orang ramai masuk ke dalam kampung. Kes ini mungkin menjadi satu lawak jenaka dalam sejarah kehakiman negara kita.



Tentangan hebat penduduk semalam disertai oleh kanak-kanak dan warga tua. Kanak-kanak kecil tersebut tidak takut dengan kehadiran polis bersama senjata mereka. Mereka bersama ibu bapa menghalang perobohan. Mereka duduk bersama di dalam rumah sehingga diheret keluar oleh pihak polis. Seorang nenek tua juga kelihatan diangkut keluar oleh polis kerana cuba mempertahankan haknya. Di sebalik keganasan ini, juga kelihatan seorang anggota polis wanita menitiskan air mata tidak tahan dengan sikap ketua dan rakannya yang berjinak-jinak dengan pemaju dalam menganiaya penduduk miskin.


Jadi, mesin jentolak, berpuluhan orang pihak pemaju bersama jentara ker

ajaan iaitu beratusan anggota polis dan FRU telah berjaya semalam. Pihak penduduk pula membuat keputusan untuk berundur seketika. Mereka mengikat satu perjanjian bersama pemaju dan menyatakan mereka akan terus tinggal di perkarangan masuk ke kampung. Ini adalah keputusan sementara. Sementara menunggu kes di mahkamah. Kes pertama mengenai injuksi akan didengar pada 14 Mac 2007 dan kes pertelingkahan tanah pula akan dibicarakan pada 27 Mei 2007 di mahkamah tinggi shah Alam. Ia juga merupakan satu keputusan sementara usaha-usaha lain diambil dalam menegakkan hak perumahan mereka. Pihak penduduk sudah mula merancang strategi mereka dalam meneruskan perjuangan

Yang pastinya penduduk Berembang belum menyerah kalah lagi. Semangat perjuangan masih membara. Sehingga pada satu ketika mereka membuat keputusan untuk membawa barangan mereka ke IPD Ampang Jaya dan bermalam di situ beramai-ramai. Cadangan tersebut ditangguhkan buat sementara waktu dan yang pastinya penduduk Berembang akan bangkit lagi, perjuangan ini belum selesai lagi.

There were only three houses to be demolished and a number of tents but yet it took hundreds of policemen and women including the FRU, the Developer's people and their thugs to demolish the houses and bring down the fierce resistance put out by the Berembang settlers and the activist who stood with them.

What would in normal circumstances take only half an hour to complete took an entire day and till the last plank was removed, the resistance never surrendered. At the end of the day, the Developer and the police went into an agreement allowing the settlers to camp just outside the current village area and the d

eveloper forked out RM 60,000 to pay some compensation. It was astonishing to see the developer who previously refuse to fork out even a cent succumb so fast. A black and white agreement was signed with the developer, the police and the people's representative putting their names on it and the agreement was scrutinized by the settlers representative which would not stop them from taking further action.

The lawyers who were at the scene Latheefa Koya and later joined by Edmond Bon and Teng Chang Khim all declared that the demolition today was unlawful and the police's action illegal. The police led by ACP Amer Awan though kept maintaining that he was only ensuring the peace took a clear side in assisted the Developer Perspektive Masa Sdn. Bhd. to carry out this illegal operation. The lawyers seeing the brutality in their own eyes have vowed to take legal action against the developer and those who assisted them at the demolition.


The current legal tussle started when on Monday, the Kampung Berembang Chairperson was served with a letter from Tabian Tahir & Co stating that the Developer of Kampung Berembang VPNSB has obtained an Interim Injunction to prevent the local people from stopping the developer's work.


The same letter states that if the people do not follow the order then the Developer can go for committal proceeding to execute the order. This is normally done after two weeks the first notice is submitted but on that same day, the developer with the full protection of RELA and gangsters from Klang started demolition work. The interim Injunction was not served on the people and legal experts have called this a miscarriage of justice.


With no regards to due process, the developer armed with RELA and gangsters and the police force went on the rampage. To make matters worst, an inter parte hearing was fixed for the 14 th. Of March 2007 which is just next week. The people managed to stop the demolition the other day. This morning, they came back again and it was said that the Selangor Chief Minister himself Khir Toyo instructed the homes be demolished and the Selangor Police Chief carried out the orders to assist the developer.


The people resistance led by 60 remaining settlers has been backed strongly by JERIT and its coalition members Urban Poor Coalition and the Youth and Student wing Coalition along with Parti Sosialis Malaysia(PSM) led the fierce fight-back. Today's resistance also saw the united front of the opposition parties joining in from PAS, PKR and DAP leaders. Tian Chua was arrested while other leaders such as Dr. Nasir Hashim, S.Arutchelvan, Hatta Ramli and Sallahuddin were all physically removed from the houses. Later, it was made known that Tian was arrested for "attempting murder" when all he did was break an illegal barricade created by the developer and their thugs to stop outsiders from coming into the village. All in, six people were arrested for various ridiculous reasons but the police though arrested dozen's of people at every encounter, released them immediately.


This morning, the developers attempted to seal the front entrance and brought in their lorries and machinery to do earth work and remove the peoples belonging as well as demolish the remaining houses. They were met by strong resistance and many fights occurred at numerous occasion. Both sides sustained injuries during these encounters. Two policewomen were removed from the scene one of them hurting her leg while the other women just broke down and could not handle the pressure.


The settlers and the activist then stay put inside the houses while hundreds of policemen and developers would try to demolish these homes. It would take the police and the developers more than an hour to bring down these houses in spite of their huge numbers. It would normally just take 3 minutes to bring down a settlers house on normal circumstances.

Background

Kampung Berembang is located at Jalan Ampang near Hospital Gleneagles. There were at one time more than a hundred families living here and they have been building this settlement forty years ago. In 2003, the people were promised low-cost houses by Pemodalan Negeri Selangor Berhad, Acmar International and Perspektif Masa Sdn Bhd. These homes were to be built near the current village but these houses are yet to be built.


Under these circumstances, the settlers were given eviction notice on 17/11/2005 to vacate the village. They were not given alternative permanent homes but were offered temporary homes at Puchong ¡V 30km away. The settlers refused and asked for relocation near-by as it is the State Government policy to relocate within 2-3km. The State used the draconian Emergency Clearance of Squatter regulation 1969 and gave the villagers seven days to get out. A group of brave settlers then decided to fight this order and they were assisted by Sdr. Teng Chang Khim ¡V the State opposition leader who was their lawyer for the case.


A temporary injunction ensured their homes were saved initially. On 14 November 2006, the State Government claimed that the land belonged to them while the settlers maintained that land had already been given to a private developer. The court fixed April 30 th. to hear the case. Just three days after that on the 17 November and then on the 20 November, the local council (MPAJ) with the assistance of the police and developers came to demolish the homes. Many people were arrested and injured. The people rebuilt the houses and on 30 November, the houses and the surau(Place of worship) was demolished. The people have since rebuilt their homes until the latest attack on 5 th. March 2007.


Aftermath

After the last house was brutally torn down, some reports have indicated that this is the end of Kampung Berembang. The battle was lost today but the war remains to be fought and won. The people have merely retreated 50 meters outside the current settlement. They have put up their tents. With their original settlement fully closed, the struggle would now focus outside. While the ground was lost today, the spirit remains among some of the settlers who have pledged to carry on the struggle.


The last three days has seen intense struggle between the settlers and the developers. The police, the State and even the courts seem to be with the oppressors. Malaysia with all its wealth cannot resolve the housing issues of its people. There seem to be no political will and the battle for housing rights is far from over ¡V in Berembang, Rimba Jaya and else where.

Don't talk only, please sign Rome Statute of the International Criminal Court!


Malaysia's former Prime Minister Mahathir Mohamad launched a war tribunal Wednesday that plans to hold trials based on complaints by Iraqis and Palestinians against world leaders including U.S. President George W. Bush.

Mahathir said he expects Bush, British Prime Minister Tony Blair and Australian Prime Minister John Howard to be among those leaders accused of committing crimes against humanity.

Mahathir is just like a funny joker. He complains without taking any practical action. Now, he makes Malaysia also like a joker country. He always forget the oppressions and human rights violations which done by himself in his own country. Many people lost freedom, home and die in custody while he was the Prime Minister. What is really sarcasm is Mahathir did not sign “Rome Statute of the International Criminal Court “ while he still was Prime Minister. So, does he really love peace and human rights?

UM, USM lulus, mengapa UPM tolak...

Baru-baru ini, melalui mesej e-mel daripada Jawatankuasa Penubuhan Persatuan Bahasa Tionghua Universiti Putra Malaysia (PBTUPM), saya amat terkejut apabila mengetahui permohonan untuk mendaftarkan PBTUPM telah ditolak oleh pihak berkuasa Hal-Ehwal Pelajar (HEP) .

Menurut mesej terbabit, pada 25 September 2006, Jawatankuasa Penubuhan PBTUPM telah mendapat surat balasan daripada HEP yang menyatakan penubuhan persatuan yang bercirikan bangsa dan bahasa adalah tidak dibenarkan serta dinyatakan larangan tersebut adalah selaras dengan Dasar Kementerian Pengajian Tinggi untuk menggalakkan perpaduan erat di kalangan warga negara dan mengamalkan integrasi kaum.

Surat tersebut turut dilampirkan keratan akhbar New Strait Times bertarikh 17 September 2006 yang menyatakan Kementerian Pengajian Tinggi tidak membenarkan penubuhan persatuan bercirikan satu bangsa, budaya dan kawasan komuniti di dalam universiti.

Larangan terbabit telah ditentang oleh Jawatankuasa Penubuhan PBTUPM berlandaskan tiga rasional berikut:

• Larangan penubuhan PBTUPM bercanggah dengan perkara 20(1) Deklarasi Hak Asasi Manusia Sejagat 1948 tentang kebebasan penubuhan persatuan dan Perkara 10 Persekutuan Malaysia mengenai kebebasan bersuara, berhimpun dan menubuhkan persatuan.

• PBTUPM bertujuan untuk memperkenalkan bahasa dan budaya Tionghua, keahliannya terbuka kepada semua pelajar yang berminat tanpa mengira bangsa. Dalam masyarakat majmuk kita, mengenali bahasa dan budaya kaum masing-masing dan antara kaum, amat berguna untuk menjalin persefahaman dan perpaduan kaum.

• Padahal Persatuan Bahasa Cina Universiti Malaya, Persatuan Bahasa Tionghua Universiti Sains Malaysia, Persatuan Bahasa Cina Universiti Multimedia, Persatuan Bahasa Melayu dan lain-lainnya, telah didaftarkan oleh HEP universiti masing-masing.

Deklarasi Barcelona

Malah di UPM sendiri, kelab-kelab bahasa dan budaya seperti Kelab Debat Bahasa Melayu, Kelab Debat Bahasa Inggeris, Kelab Debat Mandarin dan sekretariat kebudayaan kolej-kolej kediaman dan sebagainya, juga telah didaftarkan.

Jika apa yang dinamakan dasar Kementerian Pengajian Tinggi terbabit – iaitu tidak membenarkan penubuhan persatuan bercirikan satu bangsa, budaya dan kawasan komuniti di dalam universiti – maka tidak dapat dinafikan ia telah melanggar hak bahasa dan kebudayaan kaum/komuniti terbabit seperti yang ditetapkan dalam Deklarasi Sejagat tentang Hak-Hak Bahasa, Barcelona 1996 (Universal Declaration on Linguistics rights, Barcelona, 1996), di samping melanggar perkara 20(1) Deklarasi Hak Asasi Manusia Sejagat 1948 tentang kebebasan penubuhan persatuan dan Perkara 10 Persekutuan Malaysia mengenai kebebasan yang sama.

Antara lain, Artikel 15 Deklarasi Barcelona memperakui semua komuniti mempunyai hak untuk menggunakan bahasa mereka secara rasmi dalam wilayah/negara mereka.

Artikel 23 Deklarasi Barcelona memperakui prinsip-prinsip pendidikan mesti membantu kebolehan komuniti bahasa terbabit untuk mengekspresi bahasa dan kebudayaan mereka, membantu mengekal dan membangunkan bahasa terbabit, dan mengabdi kepada kepelbagaian/diverstiti bahasa dan kebudayaan.

Dan Artikel 41 Deklarasi Barcelona memperakui hak bahasa komuniti diguna, dipelihara dan ditingkatkan dalam semua bentuk ekspresi/pelahiran kebudayaan dan mempertahankan ruang komuniti daripada diduduki oleh kebudayaan lain secara hegemonik.

Tidak dapat dinafikan Dasar Bahasa Melayu sebagai Bahasa Rasmi yang Tunggal sering digunakan oleh pihak universiti untuk menyekat, malah melarang penggunaan bahasa Cina dan Tamil dalam kampus, dan melarang penubuhan apa yang dinamakan persatuan bercirikan satu bangsa dan kebudayaan.

Justeru, diskriminasi kaum dari segi bahasa dan kebudayaan telah diamalkan dengan sewenang-wenangnya melalui kuasa pentadbiran HEP Institusi Pengajian Tinggi Awam (IPTA) yang kebanyakan pegawai/stafnya terdiri daripada kaum Melayu.

Hubungan etnik

Diskriminasi kaum yang menjolok ini tentu tidak memanfaatkan penjaringan hubungan etnik yang sihat dan baik dalam kampus IPTA kita.

Jika penubuhan PBTUPM dilarangkan, persepsi pihak berkuasa HEP UPM memusuhi/ mendiskriminasi bahasa dan kebudayaan Tionghua, sudah pasti akan terbentuk dalam benak siswa-siswi Cina di kampus UPM khasnya dan di benak kaum Cina di seluruh negara amnya.

Dan kepada kaum dan siswa siswi Melayu pula, dalam suasana hegemoni bahasa dan kebudayaan Melayu, mereka langsung tidak berpeluang untuk memupuk kesedaran dan semangat menghormati bahasa dan kebudayaan kaum lain sebagai hak mereka dan berminat untuk mengetahuinya dari dekat demi kepentingan integrasi antara kaum.

Jelas sekali, justeru amalan dan suasana diskriminasi kaum inilah yang merupakan punca hubungan etnik yang kurang memuaskan di kampus IPTA dan negara kita.

Jika dasar-dasar diskriminasi kaum kerajaan tidak diperbetulkan, maka sudah pasti usaha mengenalkan hubungan etnik sebagai subjek wajib di semua IPTA untuk memupuk keharmonian etnik, juga tentu menjadi mensia-siakan saja, apatah lagi bahan pengajaran yang disediakan oleh pihak IPTA – umpamanya UPM sebelum ini – juga bersikap perkauman yang berat sebelah, dan bahan ajaran yang disediakan di bawah pantauan Kabinet kini juga sedang dipertikaikan!
Sebelum kontroversi bahan pengajaran subjek Hubungan Etnik UPM yang bersifat perkauman diselesaikan, kini timbul pula isu pendaftaran PBT. Rasanya pentadbiran UPM yang jelas bersifat perkauman itu perlu dirombak semula demi menjaga imejnya yang baik.

Their organisation has been banned for over 24 years. But it didn’t stop the students from seeking to revive the outlawed Chinese Language Society at the Universiti Putra Malaysia (UPM). However, their appeal to the campus authorities was rejected.

Today, the students took their case to the Higher Education Ministry.


Their appeal was made by a student committee set up to re-establish the organisation - which was deregistered in 1972 - through a memorandum to Higher Education Minister Mustapa Mohamed today.

The memorandum was received by Mustapa’s press secretary Amar Ikmal, who had a chat with the delegation of 25 students, comprising committee members and several other Chinese-language society members from other universities.

After the 30-minute meet however, committee representative Wong Keen Yee expressed disappointment that despite prior notification and the severity of the matter, they were unable to meet the minister personally.

“Amar said that the minister was very busy this week. However, he did say that the ministry would look into the matter,” Wong told malaysiakini.

Club forges unity


The crux of their complaint was a letter by UPM student affairs department, which rejected the application for the society’s establishment because the ministry has a policy against formation of racial or language-based associations.

The department said the policy was in place to encourage unity and integration among students.

However, repeated attempts by the committee to obtain documented proof of such a regulation from various authorities were futile, thus prompting them to raise the matter with the ministry itself.

In the memorandum, the group argued that the society aimed to promote Chinese language and culture, and its membership was open to all. It should therefore not be seen to be a racially exclusive club.

“In a country which consist of many ethnic groups and cultures, knowing each other’s language and culture can bring understanding and forge better ties among the people,” read the memorandum.

Double standards

Furthermore, the committee argued that denying the society’s registration was an act of double standards as similar societies already exists in UPM and other universities.

Examples include silat clubs (Malay martial arts), English debating clubs, Buddhist associations and Islamic students clubs.

The committee urged the university and the ministry to allow the registration of the society and show transparency in revealing the guidelines and regulations regarding the formation of such societies on campus.

In 1972, a crackdown on student activism dubbed ‘Operasi Mayang’ resulted in many student groups being deregistered, including UPM’s Chinese Language Society.

At present, only Universiti Malaya and Universiti Sains Malaysia have recognised Chinese language societies, while attempts to revive or establish such clubs exists in Universiti Teknologi Malaysia, Universiti Kebangsaan Malaysia and Universiti Utara Malaysia.

Menuntut Penubuhan Persatuan Bahasa TiongHua universiti putra malaysia

LATAR BELAKANG

Kami ingin menubuhkan Persatuan Bahasa Tionghua untuk memperkenalkan budaya dan bahasa Tionghua kepada pelbagai kaum serta meningkatkan persefahaman. Selain daripada itu, penubuhan Persatuan Bahasa Tionghua juga bertujuan untuk memupuk integrasi antara kaum. Oleh itu, kami telah menubuhkan satu jawatankuasa untuk membuat permohonan pendaftaran Persatuan Bahasa Tionghua Universiti Putra Malaysia (UPM). (Lampiran 1)

Jawatankuasa Penubuhan Persatuan Bahasa Tionghua UPM telah mengirim surat yang pertama kepada Yg. Bhg. Prof. Madya Dr. Azali bin Mohamed, Timbalan Naib Canselor (Hal Ehwal Pelajar & Alumni) UPM untuk mendapatkan piawaian tentang syarat-syarat serta prosedur untuk mendaftarkan sebuah persatuan baru di bawah universiti pada 25 Ogos 2006. Surat tersebut juga menyoal sama ada Persatuan Bahasa Tionghua boleh didaftarkan di bawah universiti atau tidak. (Lampiran 2)

Oleh sebab tidak menerima maklum balas daripada pihak universiti, Jawatankuasa Penubuhan Persatuan Bahasa Tionghua UPM telah mengirimkan surat yang ke-2 kepada Yg. Bhg. Prof. Madya Dr. Azali bin Mohamed, Timbalan Naib Canselor (Hal Ehwal Pelajar & Alumni) UPM pada 8 September 2006 untuk mendapat maklum balas dari pihak universiti dan surat ini telah dikirimkan sebagai salinan kepada Yg. Bhg. Profesor Dr. Nik Mustapha bin R. Abdullah, Naib Canselor UPM dan Y.B. Dato' Mustapa bin Mohamed, Menteri Pengajian Tinggi. (Lampiran 3)

Pada 14 September 2006, Jawatankuasa Penubuhan Persatuan Bahasa Tionghua UPM telah mendapat surat balasan daripada Bahagian Hal Ehwal Pelajar UPM. Kandungan surat hanya menyentuh tentang prosedur untuk membuat permohonan pendaftaran, tetapi tidak dinyatakan piawaian ataupun syarat-syarat bagi sebuah persatuan untuk didaftarkan. (Lampiran 4)

Kami juga mendapat penjelasan daripada Timbalan Pendaftar Bahagian Hal Ehwal Pelajar UPM, Pn. Noraihan binti Noordin secara lisan tentang tafsiran pihak universiti ke atas syarat penubuhan sesebuah persatuan di bawah universiti. Beliau mengatakan bahawa, menurut Perlembagaan Universiti Putra Malaysia P.U. (A) 106 Bahagian I Seksyen 5, mana-mana persatuan yang ditubuhkan berasaskan satu jenis bahasa atau bangsa adalah tidak dibenarkan didaftar di bawah universiti. Kami hanya dijawab secara lisan oleh beliau bagi soalan-soalan yang dikemukakan tanpa diberi pernyataan bertulis tentang syarat-syarat khusus sesebuah persatuan yang dibenarkan berdaftar. Kami telah mendapatkan satu salinan Perlembagaan Universiti daripada Lembaga Perundangan UPM dan pihak berkenaan juga memberitahu kami secara lisan bahawa segala syarat pendaftaran adalah berasaskan Perlembagaan Universiti. Pada 26 September 2006, Jawatankuasa Penubuhan Persatuan Bahasa Tionghua UPM mengirimkan surat ke-3 kepada Yg. Bhg. Prof. Madya Dr. Azali bin Mohamed, Timbalan Naib Canselor (Hal Ehwal Pelajar & Alumni) UPM untuk meminta panduan atau syarat untuk sebuah persatuan baru yang dibenarkan berdaftar di bawah universiti dan mengesahkan kenyataan secara lisan yang dibuat oleh Timbalan Pendaftar Pn. Noraihan binti Noordin. Selain daripada itu, surat kami juga menyatakan bahawa Persatuan Bahasa TiongHua UPM adalah bertujuan untuk memperkenalkan bahasa dan budaya TiongHua kepada pelajar-pelajar UPM, tanpa mengira bangsa dan agama. Dengan objektif penubuhan sebegini, diharapkan pihak Bahagian Hal Ehwal Pelajar UPM memberikan jawapan yang nyata dan jelas sama ada Persatuan Bahasa Tionghua boleh didaftar di bawah universiti atau tidak. Pada 2 Oktober 2006, Jawatankuasa Penubuhan Persatuan Bahasa Tionghua UPM menerima surat daripada Bahagian Hal Ehwal Pelajar UPM menyatakan bahawa penubuhan persatuan yang bercirikan bangsa dan bahasa adalah tidak dibenarkan serta memaklumkan kepada Jawatankuasa Penubuhan bahawa larangan berkenaan adalah selaras dengan Dasar Kementerian Pengajian Tinggi untuk menggalakkan perpaduan erat di kalangan warganegara dan mengamalkan integrasi kaum. Surat tersebut turut dilampir keratan akhbar New Strait Times yang bertarikh 17 September 2006. Keratan tersebut menyatakan Kementerian Pengajian Tinggi tidak membenarkan penubuhan persatuan bercirikan satu bangsa, budaya dan kawasan komuniti di bawah universiti. Ia juga menyatakan bahawa pihak kementerian akan kaji semula undang-undang untuk membubarkan persatuan yang sedia ada seperti Persatuan Bahasa Melayu yang telah wujud selama satu dekad. (Lampiran 7)

Pada 25 Oktober 2006, Jawatankuasa Penubuhan Persatuan Bahasa Tionghua UPM mengirimkan surat ke-4 kepada Yg. Bhg. Prof. Madya Dr. Azali bin Mohamed, Timbalan Naib Canselor (Hal Ehwal Pelajar & Alumni) UPM untuk meminta pihak universiti mengemukakan pekeliling tentang dasar Kementerian Pengajian Tinggi yang dinyatakan dalam lampiran keratan akhbar yang disertakan dengan surat balasan pihak Bahagian Hal Ehwal Pelajar UPM yang bertarikh 2 Oktober 2006. Disebabkan tidak menerima maklum balas daripada pihak universiti, Jawatankuasa Penubuhan Persatuan Bahasa Tionghua UPM telah mengirim surat kepada Y.B. Dato' Mustapa bin Mohamed, Menteri Pengajian Tinggi pada 20 November 2006 untuk mendapat dokumen sah tentang dasar Kementerian Pengajian Tinggi yang dinyatakan dalam surat pihak Bahagian Hal Ehwal Pelajar UPM yang bertarikh 2 Oktober 2006. Oleh sebab belum dapat maklum balas daripada pihak Kementerian Pengajian Tinggi, Jawatankuasa Penubuhan Persatuan Bahasa Tionghua UPM telah mengirim surat kepada Y.B. Dato' Mustapa bin Mohamed, Menteri Kementerian Pengajian Tinggi pada 24 November 2006 untuk dialog perjumpaan membincangkan perkara pendaftaran serta penyerahan memorandum. (Lampiran 10)

Pada 29 November 2006, kami menerima surat daripada Bahagian Hal Ehwal Pelajar UPM untuk menjelaskan permohonan untuk memperolehi pekeliling tentang dasar Kementerian Pengajian Tinggi yang dinyatakan dalam surat yang bernombor siri UPM/BHEP/UKSA/1. Bahagian Hal Ehwal Pelajar UPM telah sekali lagi menegaskan bahawa larangan penubuhan persatuan berasaskan bangsa dan bahasa adalah selaras hasrat Kementerian Pengajian Tinggi. (Lampiran 11)

SEBAB-SEBAB

Kami membuat tuntutan kepada Kementerian Pengajian Tinggi adalah atas sebab-sebab berikut:

1. Deklarasi Hak Asasi Manusia Sejagat 1948 Perkara 20(1) Setiap orang adalah berhak kepada kebebasan berhimpun secara aman dan menubuhkan persatuan dan Perlembagaan Persekutuan Malaysia Perkara 10 Kebebasan bercakap, berhimpun dan menubuhkan persatuan jelas menunjukkan bahawa setiap individu (rakyat) mempunyai kebebasan untuk berpersatuan. Hasrat untuk mewujudkan Persatuan Bahasa Tionghua merupakan hak asasi rakyat juga.

2. Kewujudan Persatuan Bahasa Tionghua adalah bertujuan untuk memperkenalkan budaya dan bahasa Tionghua kepada masyarakat. Keahliannya terbuka kepada pelajar yang berminat pada bahasa dan budaya Tionghua, bukannya berasaskan perkauman. Jadi adalah jelas bahawa Persatuan Bahasa Tionghua bukanlah sebuah pertubuhan yang memupuk semangat perkauman serta merosakkan perpaduan kaum. Dalam sebuah negara yang terdiri daripada berbilang kaum dan berbilang budaya, mengenali bahasa serta budaya kaum masing-masing mampu menggerakkan persefahaman sesama kaum dan seterusnya mewujudkan persaudaraan serta perpaduan di kalangan rakyat negara yang terdiri daripada berbilang kaum.

3. Tindakan pihak universiti menghalang penubuhan Persatuan Bahasa Tionghua sebagai persatuan yang baru adalah tidak munasabah dan tidak wajar, sedangkan di universiti kerajaan serta swasta tempatan yang lain mempunyai Persatuan Bahasa Tionghua yang berdaftar. Persatuan Bahasa Tionghua atau persatuan asas bahasa yang lain yang berdaftar pada masa kini termasuklah Persatuan Bahasa Cina Universiti Malaya, Persatuan Bahasa Tionghua Universiti Sains Malaysia, Persatuan Bahasa Cina Universiti Multimedia (Cyberjaya), Persatuan Bahasa Cina Universiti Multimedia (Melaka), Persatuan Kebudayaan Cina Universiti Tenaga Nasional, Persatuan Bahasa Cina Kolej Tunku Abdul Rahman, Persatuan Bahasa Cina KLIUC, Persatuan Bahasa Melayu, Persatuan Seni Tari Budaya masing-masing, dan lain-lain. Adalah tidak munasabah bagi pihak UPM menolak akan penubuhan Persatuan Bahasa Tionghua atas sebab ia merupakan persatuan yang berasaskan satu bahasa dan satu budaya.

4. Terdapat juga persatuan yang berasaskan satu bahasa, satu budaya atau satu agama yang berdaftar di bawah pihak Universiti Putra Malaysia, seperti Kelab Debat Bahasa Melayu, Persatuan Buddhist, Persatuan Mahasiswa Islam, Kelab Debat Bahasa Inggeris (DOSE), Kelab Debat (Unit Mandarin), Persatuan Seni-seni Silat (Lincah, Sendeng, Gayong), Kelab Nasyid Nahwan Nur, seketeriat kebudayaan kolej-kolej kediaman dan lain-lain. Nyata sebab yang dikemukakan oleh pihak Bahagian Hal Ehwal Pelajar UPM untuk menolak penubuhan Persatuan Bahasa Tionghua UPM adalah tidak munasabah dan mempunyai pendirian yang kabur (double standard).

TUNTUTAN

Justeru, Jawatankuasa Penubuhan Persatuan Bahasa Tionghua UPM menggesa pihak Kementerian Pengajian Tinggi agar menerima 3 tuntutan kami:

i) Kementerian Pengajian Tinggi dan pihak Universiti Putra Malaysia menarik balik kenyataan tentang dasar Kementerian Pengajian Tinggi yang menyatakan larangan penubuhan persatuan yang berasaskan bahasa dan budaya di universiti. Sekiranya pihak Kementerian bersetuju dengan kenyataan berkenaan, ulasan harus diberi dan dokumen secara rasmi tentang dasar tersebut harus dikemukakan..

ii) Kementerian Pengajian Tinggi serta pihak Universiti Putra Malaysia mempertimbangkan permohonan Jawatankuasa untuk menubuhkan Persatuan Bahasa Tionghua UPM secara adil dan saksama serta membenarkan penubuhan Persatuan Bahasa Tionghua UPM dengan segera.

iii) Pihak universiti-universiti tempatan yang lain mengemukakan syarat-syarat kebenaran untuk menubuhkan sesebuah persatuan dan pertubuhan secara jelas dan terbuka, agar lebih banyak pertubuhan yang masih tidak berdaftar di bawah universiti dapat berdaftar dan seterusnya mendatangkan lebih banyak kebaikan kepada mahasiswa yang merupakan harapan masa depan negara.
